Tradesman Damaged my flooring

A month ago, I had a new boiler fitted. As the tradesman was carrying the old boiler out of my property he dropped a part of it and it took a chunk of of my engineered wood flooring.

It was an accident so I didn't get angry but asked for him to repair / replace it or claim on his insurance.

He asked me to claim on mine but is said no.

He has sent 2 different repair people out and both can't repair it so it can't be seen.

I have sent him the details of where we got the flooring but it's no longer available.

I had paid half the money up front for the boiler with the rest to be paid on satisfactory completion.

He has sent me an email saying that he admits the flooring is still not repaired so you can see the damage but he has done his best.

He is refusing to give me his insurance details and said unless I pay the remainder of the money then he is going to take me to the small claims court.

Advise please!

    Get quotes from floor repairers and claim direct from the tradesman that caused the damage. You do not need to know his insurers - it is up to him whether he deals with your claim himself or passes it to his insurers.

    Or, claim off your insurance and advise them that the tradesman has admitted causing the damage.
    Then leave your insurance company to deal with the errant tradesman and his insurers.

    That may leave you an excess to pay, but that depends on your insurer.

    Do you have legal assistance via your insurer? Perhaps they can get the trader to do the right thing.

    A number of years back I had my wood floor damaged by tradesmen delivering a fridge freezer. Instead of using their hand truck to bring it through the house to the kitchen they wheeled it in on the fridge's own hard, plastic casters, you can imagine the result. In the end the retailer passed it on the their insurer who actually stumped up for the cost of a brand new floor throughout, given that the floor had aged and any repair would've been obvious and unsightly.

    As above, if you can't get hold of his insurer then you may need to go with your own and instruct them to make a claim against his public liability insurance, if he has it.
