Lack of Building Regulations Indemnity Policy

    The policy is worthless because of the information not provided by your vendor. He is the one at fault as he took out the policy (according to your 1st post).
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    Sorry if I sound a bit silly here, but would the vendor be the person themselves who sold the house? Or would it be their solicitor or estate agent?

    If I knew that I would be able to know how I can try and rectify this mess.

    The vendor's solicitor sells the policy (as agent for the insurer) to the vendor. So it is possible the vendor's solicitor may have made the mistake. But the vendor should have checked the details were correct when he was given the policy document, as it is the vendor who you are contracting to buy from and it is the vendor to whom any claims for redress would be made.

    But having said that there is always the possibility that the vendor didn't receive or read the document and it was just kept with the transfer papers by the solicitor. It can be argued that the vendor's solicitor is at fault as he should have checked the details on the document, presuming he saw it before passing it to the vendor. But as you had no contract with the vendor's solicitor you cannot claim against them. The mistake may even have been made by the insurance company issuing the policy.

    If your solicitor didn't receive the policy document until after completion, then he is in the clear. But he received it prior to completion, he should have checked it, and delayed completion (or even exchange, if it were possible) until it was sorted out.
