Car Insurance Problem - Advice needed

Hi,
I made a claim on my car insurance because a fence from a building site across the road fell in the night and smashed the side of my car. It has taken three months to hear of any progress from my insurance company (Tesco) despite phoning them constantly.
They have finally responded today stating that the weather that day was forecast to be medium to high winds and therefore the accident is attributed to an "act of God". I will have to pay the excess and claim against my own insurance rather than the building company.
Is there anything I can do in this case?

Unfortunately, in order to claim off another parties insurance company, you have to prove they were negligent. In this case, if the fence blew down in a storm, the insurers would class it as an act of god.
They are correct in advising you to go through your own insurers. Might be worth getting a quote and weighing up the costs vs claiming with an excess.0
