Virgin media faulty mobile

My daughter has a VM mobile contract she has a samsung phone before the 12 month warrenty was up the phone overheated and continually developed faults , finally the phone was returned for repair ..however the faults continued after the phone was returned , VM exchanged the sim card 3 times the phone was restored several times but still it was faulty and once again got extremely hot ..My daughter was continually missing calls , texts etc and at times unable to make calls., she relies on it for work and family commitments ,VM tried to blame EE as they use their network , but we have proved it was not a network issue..they have again offered to have the phone repaired something that they have already attempted prior . We have contacted Samsung who say they only offer a REPAIR service not a exchange service ...all the time this is going on VM are still taking the monthly contract fee ...How do we proceed , if we can that is after all we have a £600 phone which we are paying for and cant rely on ..any advise would be welcome ..

    (but we have proved it was a network issue )

    Confused as neither VM nor Samsung can repair a network issue .

    Apologies ..despite proof readin I missed the typo
    ..corrected ..we have proved it was not a network issue IE hardware fault not software ....hope this clarifies things
