Parking Eye - Moat House Stoke

Options
I have a feeling I already know the answer to this. My girlfriend entered this car park and parked up, with the plan to pay at the front desk after the conference. She headed to the hotel front desk, only to be told the car park is for residential guests only and anyone who parked there had to enter their reg details into the computer in the front foyer which are for residents though.

Anyone not a residential guest, should not park there and cannot pay too. 5 days later, she receives a PCN for £100 from Parking Eye, complete with photos and times, which wasn't entirely unexpected.

I assume she's bang to rights here. Ignorance is not an excuse and all that?

    everybody has a "case"

how long was the vehicle there for ? (the PE pcn will tell her this)

if it was less than 10 minutes then clause #13 of the BPA CoP applies

What utter garbage how on earth can you attend a conference and find out you can't park your car, I think the Muppet on the front desk was talking out of their neck.

In fact on their own website under conferences it states:

There's also free on-site parking for up to 350 cars.

I would get onto the manager ASAP and complain bitterly also read the newbies thread on here for how to formulate your appeals.

No you should not be paying this, and it's not a question of being "bang to rights" this is a private parking invoice in an unregulated industry not a real fine.

Direct her to the newbies FAQ thread near the top of the forum.

(Everyone is politely asked to read it before starting a thread)

There she will get advice on how to deal with this.

Thanks for the link. So you think she might have a case?

I can tell she wants to just pay the £60 discounted fine, unfortunately. They really are bullies though, the letter is very threaty threaty.

berst bet is a complaint to the landholder then, from the RK , asking them to waive the charge, then make sure it comes from PE as a cancellation

this can also be challenged using the blue text template and then taken to popla

    no contract
    inadequate signage

    etc
