3) The car park signage was inadequate.

Hi, Ive had a POPLA appeal rejected. We paid to park at Tower Street Newquay while we were in Newquay for a family holiday. The PayByPhone app wouldn't let us park beyond 6pm. The ticket machine also spat out money to my sister-in-law to pay beyond 6pm, leading us to assume it was free after 6pm. We overstayed according to the camera snaps by 19 minutes and we have been issued PCN's for £100. (My sister-in-law didn't appeal and has paid her £60 PCN)
I appealed through Parking Eye, then through POPLA and they have rejected our appeal. The car park was almost empty when we left at 18.13. we returned to the car at 6pm, got ourselves sorted (kids in car, made a phonecall) and left at 6.13pm. We entered the car park at 15.56.
We have been advised that there is a ten minute grace period, so we have been charged an unbelievable £100 for 9 minutes over the allotted time. This was absolutely unintentional and we had paid to park.
Do you have any advice on how we can get round having to pay the extortionate £100 fine? Thanks!0 -
you should start your own thread
all you can do now is wait for up to 6 years for an LBC or an MCOL and then fight them through the courts (as there is no "next step")
clearly you did not argue clause #13 of the BPA CoP strongly enough to POPLA
there are TWO grace periods , not one
and its not a "fine" , its an invoice
plus the BEAVIS case 2 years ago will have put paid to any claims that you think the INVOICE is extortionate or unconcionable0
