You don't seem to have pushed them on 'take me to court (and lose) by issuing proceedings within x days or I consider the case closed'.
Personally I wouldn't go explaining what E v L is all about, just tell them they should not rely on it as there is now clear evidence from many county court judgments across the country that this does not apply in a civil case.
Make your response much more sharp, snappy and assertive; you don't want them entering into any dialogue, all you want from them are court papers or a cancellation. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

elliot vs loake , missing R at the end for driver
I would suggest you also cite the 2 court case numbers and dates where the legal arguments for A V L were rubbished by the judges this year
lamilads case was the first one and the other one this week on parking pranksters blogsite (in cardiff) was the second one , where the judge really went to town on why that argument fails and also quoted the lamilad case too
you should find both on parking pranksters site0 -
Thanks, found both @Redx.
If I do say say "Please cancel or issue court papers within 14 days, or I will count further contact as harassment and seek legal advice", what legal basis does this have if they issue small claims court papers within say, 21 days, or 23 days?0 -

None at all. It's all posturing, but designed to stop them sending endless threatograms and wasting your time.
But don't talk about 'seeking legal advice', it shows a person to be unsure of their position. You could say 'and will seek a legal remedy in the form of a claim or counter-claim for compensation for harassment and data misuse.'PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
