Parking Fine For Staying Too Long

Hello all,

I received a 'Parking Charge Notice' today from a retail park car park. Moorgate Retail Park in Bury to be exact. Admittedly, I stayed nearly 2 hours over the allowed time but I've read that these aren't backed by law. When I went to the car park, I went to the KFC, then drove to the other section of the car park to do some shopping and to get my car sorted at the Halfords. However, this journey from the KFC to the Halfords isn't seen by the cameras so as far as they're aware I went in and parked for 4 hours. £60 is a lot to pay and I'd much rather not pay it if I can get away with it. So what do I do, do I pay up or do I let it slide? After all, I've read that these aren't enforced by law and simply just invoices with no payment deadline.

    read that NEWBIES sticky thread and follow the procedures in there

    also google BARRY BEAVIS who also thought like you , he lost 3 times in court and the last time was at the SUPREME COURT in London, about 20 months ago

    then decide if it cannot be enforced legally (it can , ask BARRY)

    the payment deadline is 6 years by the way

    that is the time period the PPC has to issue an MCOL in the small claims court (google it) - this is what happened to barry beavis

    so please gen up properly and dont believe the twaddle you have read so far

    and to get my car sorted at the Halfords.

    from that it appears that there is a Halfords autocentre on the retail park, of which you used to get your car sorted.
    so you have Visit 1, KFC
    Halfords autocentre to get some work done to your car
    Visit 2 back into the car park.
    From the Plain Language Commission:

  • Sort of yeah, however, the KFC and Halford's auto centre are two different sections of the same car park and so the enterence camera has seen me go in but none of the cameras could see the journey from KFC to Halfords, then the exit camera saw me leaving 4 hours after.

    I had a look on the sticky thread on how to appeal but I'm unsure on whether it's advisory for this given the length by which I overstayed.

    Circumstances don't matter. The appeal is one-size-fits-all, to get a POPLA code if it's a BPA firm.

  • PE on the site, BPA are also on the list lapping up some credit for being !!!!!!. If I appeal and then lose will the cost go up to £100 or stay at £60?

    Costs? What costs? Why not just read the forum. All cases are the same, all PCNs are the same. The 'discount' is a bribe not to appeal and the charge is in fact £100. And almost no-one pays it here.

    You haven't even said whether your PCN is a 'POFA' one of not, received within 15 days? A section about the POFA 2012 on the back?

    You should also be complaining to the landowner, if,a you said your vehicle was in to be serviced then it was not parked - but being worked on.
    also a complaint to Halfords wouldnt go amiss.

    Another aspect could be a data protection act breach, as if you vehicle was being worked on it effectively made two trips to the car park
