My plan is to hold a percentage of the payment (may be 10%) until I receive all the paper work and verify it with the council. I hope this will be enough to ensure things are done properly
You cannot do any retention unless you have written agreement in advance. Which is where a contract comes in. If you have concerns about anything, be it the builder, the workmanship, materials used, quality, or whatever, just holding back a retention is not the way to deal with matters. All issues should be addressed as an ongoing regime through the works. In addition it is not the AI's role to act in this way. Their role is to undertake whatever has been stipulated as agreed inspection stages. Here there is a flaw with AI's, but provided you have tackled and agreed these inspections then fine.0
