New EU rules - will Three's roaming be 4G??

Given the new EU rules of 'roam like home', will the currently capped 3G speeds for Three's Feel At Home roaming switch to 4G? I'm sure the letter and spirit of the EU rules would say yes, but I can't see this explicitly mentioned on their website. If not, is this legal?
