Hi all,

Just looking for some info/moral support.

A letter has been issued in the post from Parking Eye, it's a £100 fine (reduced to £60.00 if paid within 14 days)


Ticket purchased: for 1 hour although it doesn't the state the time the ticket is valid until.


It says on the back of the letter, vehicle entered the DW Sports Wigan pay and display car park (at the said times above) and that the signage which is clearly displayed at the entrance says this is private land and that it is managed by Parking Eye. In addition the signage states that as a paid car park, a parking charge is applicable if the motorist fails to make the appropriate tariff payment..... By either not purchasing the appropriate parking time or by remaining at the car park for longer than permitted , in accordance with the t&c's set out in the signage the parking charge is now payable to parking eye.

Please could someone tell me if there is a grace period for getting to and from your car.. In neither of the photos is the car stationary, its on the way in and on the way out.

(The driver still has the parking ticket)


Please could someone advise the best course of action / template to use.

    It is not a fine.

    You should edit the date and times from your post as this identifies you to the parking scammers, especially if you have used your real name as your user name. They monitor this forum looking for people who give away the driver's identity.

    Please read the Sticky thread for NEWBIES then send the BPA appeal tempate in blue. You could if you wish add that the BPA CoP allows two grace periods which the scammers have not applied here. Do not reveal the driver's identity. Do not say I parked or anything like that.

    In addition you should complain to the landowner. We have seen a lot of DW Sports complaints here recently so they need to be told in no uncertain terms that they will lose customers if this isn't cancelled.

    If it isn't cancelled then read up on how to beat the scammers with a PoPLA appeal, and leave negative feedback about this place on social media to warn others of the scam.

    The one in the NEWBIES PLEASE READ THESE FAQS FIRST thread. Plus a couple of lines about the P&D ticket, proving the driver did pay.

    We'll give lots of moral support and direct support. You appear to have misunderstood the reason for the PCN, however; this is NOT about six minutes.

    Hopefully you followed MSE advice and kept the P&D ticket?

    I expect there was a VRN typo when paying, and you merely need to prove you paid for the hour. This is NOT about six minutes, and cannot be. EDIT, I see you can prove payment:

    So, look at the VRN. Typo? Keypad fault? The ticket the driver paid for, has to show the VRN in full.

    If that is what the driver is required to enter and they are correct, then there is no problem. The driver paid for parking.

    Even if the numbers were put in wrong, you still show that a ticket was paid for a car with similar numbers.

    Just start with the BPA template from the NEWBIES as advised, include a copy of the ticket stating that parking was paid for, and complain like mad to the landowner/DW Sports.

    Please also not that the BPA Code of Practice allows two grace periods which have also not been applied .
    There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.
    I do not give you consent to process data relating to me or this vehicle. I deny liability for any sum at all and you must consider this letter a Section 10 Notice under the DPA. You are required to respond within 21 days. I have kept proof of submission of this appeal and look forward to your reply.

    This is nothing to do with Grace periods and everything to do with only inputting numbers.

    So I suggest:
    You have incorrectly issued a parking ticket, please find attached a photograph with proof of purchase of parking for vehicle with registration:

    The driver's ticket shows the three numbers from the registration, which your machine accepted and is common with many such P&D machines, where only the numbers are required, to identify the car. From this evidence I have attached, you can see that the driver did in fact pay and display. It was a very sunny day and any information shown on the scratched/unclear pay & display machine screen was unreadable due to glare, so the driver pressed the keypad numbers, as one would normally do on street, got a ticket and had no idea there would be any problem. The driver made very reasonable endeavours to comply with the terms, and paid the required tariff in good faith. If you require the full VRN, your system should surely be set not to produce a ticket based on just numbers.

    There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge. I do not give you consent to process data relating to me or this vehicle. I have kept proof of submission of this appeal and look forward to your reply, and hope on this occasion you will cancel the PCN for a genuine patron who paid & displayed.

    Click 'registered keeper' on the dropdown menu and make sure you attach the P&D ticket.
