Refund ?

hello everyone.

Not sure this is the right place to post but if not please remove.


I have brought a motor vehicle from a commercial dealer and paid in full by bank transfer and i was going to leave it with them till i could get down to collect, they said that's fine, before buying i asked was the vehicle all ok and nothing wrong with it, they said no and the dealer drove it himself and gave it a basic check over and all was ok, they also said if i was not happy or the vehicle had any major problems i can have a refund.

I received the vehicle and left it in my yard and got a commercial place just down the road from me to check it all over before i drove it and they rang me and said it's no good and send it back to them.

They have agree to refund me but i have to get the vehicle back to them, it's cost me £400 to have it delivered, another £200 to get it checked over, and now another £400 to get it back down to them, the thing is i wanted it trailing up to me, which they knew about but instead they drove it back and did not tell me till it was half way back.

So they have agreed to refund me, i said i will pay only £400 to get it returned, but they said i can not have a refund till it's vehicle is back with them, can they keep my money like that or not and do i have to pay for the return delivery ?

    Your choice to buy a vehicle a long distance from where you live and if you want a refund you have to return the vehicle to them at your expense.

    Yes i said i would pay for the return transport of it, but they told me it is all ok to drive and there are no problems with it, it's leaking oil, water, gearbox has been damaged and most of the rubber mounts are missing or pitted, exhaust is falling off there is more to much too list.

    Can they keep my money till it has been returned ?

    Of course, you can't expect them to give you the money until they have the vehicle back

    Ok

    Who would be responsible if it breaks down on the way back down, they know all the problems .

    The person who owns the vehicle.

    I have never received the V5 with it to fill in.

    V5 is not an ownership document, it's a keeper document. You became the owner when you paid for it.

    V5 is not ownership just registered keeper who is liable to tax it and receive any notices of speeding tickets.

    But you paid for the vehicle and have it in your possession, ownership has been transferred to you. If you try to claim the dealer still owns the vehicle then why have you spent £600 transporting and having the vehicle checked over?

    Oh i see now.

    So they sold me a vehicle which is not fit for purpose, drove it back without letting me know, charge me £400 to bring it up, and now £400 back down, £200 to get it checked over, they keep my money till it returns knowing it might not make it .... WOW .... nice learning curve .
