CEL have only one shot at getting you address, from the DVLA within 2 - 8 weeks (depending whether it was ANPR or windscreen ticket). They cannot access your details again in regard to the one ticket. Even if you subsequently update your details, the DVLA does not update those with CEL. The council Electoral Roll plays no part.

Ok thanks, I guess there's no reason to include it then.

Could you advise on my supporting statement above please?

I agree, and should be removed here, as well as the August year put right to 2016:
however I have since moved and have been living at my current address since August 2017. In support of this I can provide a tenancy agreement signed by myself and my landlord dated the 26th August 2016. [STRIKE]I also have confirmation from xxx Council showing my entry on the electoral register in March 2017 at my current address.[/STRIKE]

And the OP needs to remove 2.5.2 and 2.5.3 as 'no loss' holds no weight.

Ok so I have removed the 2 points around 'no loss' and corrected the error on the August year, so it looks like I am good to go.

Thanks very much to you both for helping with this
  • Hi Umkomaas, Coupon-mad & Half_way

Had my court date today and as you can probably guess CEL didn't show or provide any written details to the court of their partculars etc.

The judge ruled to set aside the CCJ purely based on the evidence I had that the alleged paperwork from CEL was sent to an address I did not live at and as such I could not respond. The judge originally planned to ask CEL to contribute to my court costs rather than pay in full but I spoke about their record in terms of not complying with POFA Schedule 4 and this seemed to help as the judge then awarded me my costs in full.

Really appreciate the help and guidance provided - Thank you

Did that include your £255 set-aside fee?

So to clarify this included the £255 fee but nothing else, I didn't actually ask for anything more and not sure if I could have but I'm pretty happy with the outcome anyway!

Unfortunately my dealings with CEL are still rumbling on - would really appreciate any advice on how best to deal with this situation

As a recap/update: In 2017 I found out about a CCJ served to an old address by Civil Enforcement Limited - using the advice on the forum I successfully challenged and had the judgement removed and got my costs paid by CEL. Later in the year I found out about 2 further CCJs served to that address from CEL so went through the same process. Half a year down the line I've just found out about 2 more CCJs so will be going through the same process again.

Given that on the 3 previous occasions CEL have had to use my correct address in order to send me cheques to reimburse my costs is there anything I can request on the draft orders I send with the N244 to stop CEL pursuing claims at an address they know I do not live at?
  • When were the last 2 claims submitted in relation to when CEL knew about your new address. I.e. before or after?
