About to exchange on a house thats now part of a contested estate in a will. Help!

Since none of us have seen the contents of the will, it's impossible to say.
But ultimately it's not your problem ... other than you should walk away now and chalk up the lost costs to experience.
Of course you could always do some digging and get a copy of the will - then you'll have some idea as to whether the partner has the ability to properly throw a spanner in the works0 -
Out of interest, how would i get a copy of the will ? That really would shed some light on things!0

Ok, thanks for the reponses, were both of the opinion its not going to end well now! We thought we'd covered all bases by asking all the right questions from the start but obviously not factored in the sheer greed and inconciderate nature of some people.
I've had a look at other properties on the market now and really there is nothing available to buy within a 10miles radius of this property that we can afford to buy. So only thing we can do is wait and see if this pans out and hope that something else pops up in the coming weeks. Our mortgage offer is valid til end of september. We may still be able to use it if we find somewhere in time i guess!
I'll post again an outcome incase anyone else is interested how this pans out.

As i thought really but the the daughter isn't just turfing him out. It was an agreement that the house be sold from the beginning, he now seems to have changed his mind and wants more.
You are getting too involved in whats going on. All you shoudl care about is, when will the position be clarified. A calendar rather than a stopwatch will be needed to time that.
He cant claim the entire estate to himself though can he? The estate agent has advised that he doesn't seem to have a leg to stand on and the daughter is willing to renegotiate how much he gets to move on. But she shouldn't have to forfeit her entire inheritance should she?
Don't care and neither should you, all you should care about is, this is a big ugly mess, so either walk, or wait (most likely a very long time)0 -
Please don't judge the partner in this he may have a very valid reason for contesting the will. We don't know how much he contributed to that property. He may have found that he some of what he contributed has been left to the daughter and if she gets that as well as her mother's money he will be homeless. He may have had legal advice about this. If he has inhertited a small percentage of the property then the daughter will have to force the sale through the courts.
When you say that this is the only house you can afford do you mean in that size or the only one in any size?0 -
Avoid probate houses at all costs unless their vacant and seems straight forward. Just walk away"It is prudent when shopping for something important, not to limit yourself to Pound land/Estate Agents"

A Will is a public document so as probate has been granted, it should be possible for the OP to get a copy of it.
However, this does not really help him - only the executor can deal with the matter and it may end up with the court for a decision if the partner proves intransigent.
It seems to me that the partner is likely to prove the loser if the court decides that he is a vexatious litigant - there could be be an order for sale with costs awarded against him and coming out of any share he may be owed?0 -

If it's the only thing you can afford within 10 miles then they are almost certainly selling it too cheaply unless there is something wrong with it; that could be why one of them has decided they are not happy.0
