ParkingEye/appeal risk?

Hi,

I have been reading through all of the information on this board and would firstly like to say thank you for all of the information collated here and for the time you put in helping people challenge parking fines.

So, the keeper of the car received a parking charge notice, issued 25/05/17 (received 2 days ago). 2 hours parking were paid for however, the car overstayed by 17 minutes according to ParkingEyes images of the car exiting the car park.

I have read the newbies thread and submitted a first appeal directly to ParkingEye using the template in blue (and stating 'registered keeper' with no mention of driver). From reading this forum I expect PE to reject my appeal and issue a POPLA code. My concern is that I have read on a few threads that if you lose the POPLA appeal then ParkingEye will sue?? What are the chances of this happening ? Would they not just require the fine to be paid if the appeal is lost?

    If you lose at POPLA there is a long process before court. At worst it goes to £100 if you chose to settle after losing at POPLA.
  • Ahh, ok thanks. I just read on one of the threads regarding PrivateEye that if you lose at POPLA, they will sue. It just worried me slightly in case I was getting in to something more stressful than the initial fine, which I now know is not the case. I shall put together a draft of my appeal.

    You need to read other Grace Periods POPLA appeals people ahve written recently, easy to search for: 'POPLA Grace Kelvin eleven' would find some good ones nice and quickly, as long as you change the search to ''show posts''.

    Do you mean an overstay of 17 minutes at the end, or 17 minutes altogether (e.g. 7 minutes to drive in and pay and ten minutes after paid-for time?) What exactly? You can normally tell by looking at PE's website records of your case.
