I have a credit card debt which was bought by Max Recovery Limited back in late 2012.
At the time, I was under an IVA which started on the 1st June 2012.
Sometime in 2016, I had started receiving letters from Drysdenfairfax Solicitors acting on behalf of their client, Max Recovery.
I had asked repeatedly for evidence of the debt ie a signed and valid credit card agreement, and a copy of the deed of assignment.
The last correspondence I had from Drysdensfairfax Solicitors was dated the 11th March 2016.
They provided me with a basic office copy credit card agreement. It looks like the credit card agreement was done online as it has no wet signature.
They claimed their client, Max Recovery had provided a copy of the deed of assignment, and that it was included.
Upon perusal of the paperwork, this was still missing.
Fast forward a year later, I heard no more from Drysdenfairfax Solicitors.
Upon perusal of my credit report yesterday Drydensfairfax have placed a default on my credit file!!
I have not received a default notice under section 87(1) of the consumer credit act 1974.
Secondly, they do not owe the debt, why are they placing defaults?
As they are only a solicitors, they should have no access to my credit file anyway!!
Also the date of default is incorrect.
They are saying the account went into default on 3rd August 2012 when it was actually the 1st June 2012.
Also, why as it taken 5 years to register this default anyway!?
It would have been statued barred next year!!
I'm very angry at this!!
