Linden Homes threatening to pull out slow buyer

Hi all

We reserved a house with Linden Homes a new build company, and had a cash buyer in tow for ours all ready. Paid the reservation and they wanted contracts exchanged as fast as (latest 27th April, we reserved early March) however we have been one of the unlucky ones who have had a slow buyers solicitor to the point I'm tearing my hair out with some of the ridiculous enquiries being raised again and again (add that in with long delays of response) the buyer still wants to buy but I basically had Linden Homes sales rep on the phone yesterday threatening that they will pull out if not sorted by the end of June.. As you can gather I'm not sure what else to do...I cannot badger the others anymore than I already do! We are using the recommended solicitor from Linden Homes and apparently he has been pushing and pushing it.

My questions are... should I be worried about losing the house? Should I try and ring Linden and speak to the head office and plead my case?

P.s all mortgage on everything on our side is all ready in place to go...just waiting on the buyers for the final hurdle!

    Are you sure it's the solicitor that's 'dragging their feet' and not the buyer?

    Perhaps the best option is to chase your buyers to find out exactly what the problem is. If you're selling through an EA, ask them to contact the buyers.

    (Typically, people don't say things like "I'm having trouble raising the cash" or "I'm having second thoughts about buying" - they just say it's their solicitor's that's slow.)

    And if there is a problem with the responses you are giving via your solicitor, find out what the problem is and get it sorted.

    If you and the buyer agree that the enquiries are ridiculous/unnecessary, the buyer just has to say that to their solicitor - and it will be sorted.

    Linden have a 30 June financial year end, and accordingly, there is massive pressure to get in as many completions as they can before that date to make the company's results look as good as possible. This pressure comes from head office - it's not something the sales staff on the ground made up.

    Therefore, if they think they can dump you and find someone else who can move before the end of the month, they will. How popular is the site?

    To be honest I'm not sure on popularity, we have so many different new build areas popping up all over this town. We are supppsed to be one of the first few purchases though, there ars still hundreds left to be built yet.

    What you are saying about the financial year makes sense. Hmm it looks like we are going to have to have a back up plan in mind seeing as its not looking great...

    I agree with Tim RE Lindens year end.

    They are part of Galliford Try and contribute a significant amount of the profit for the group as a whole so there will be pressure.

    Having said that i'd be surprised if they were to pull the rug from under your feet.

    Site management/sales don't need the hassle.

    All you can do is chase things at your end.
