Buyers solicitor is asking for these..

As stated in my letter;

1. Please show the seller a copy of the covenants and obtain confirmation they have not been breached

(Is this just a simple call/write back to say I agree?)

2. Please supply a copy of the NHBC certificate or equivalent, and the planning permission, building regulation consent and building regulation completion certificate as we note the property is less than 10 years old.

(I have turned the flat upside down and I can't find this certificate - what do I do?)

3. Please supply a copy of the electrical test certificate referred to in 12.1 of the property information form and confirm the original will be handed on completion.

(Again, I can't find this so what do I need to do?)

I'm at a bit of a panic here and thought I'd ask here before I call solicitors up tomorrow to see if I can resolve it any quicker!

  • Contact whoever signed off the building regs, ask for copies of the documents, probably a small fee to pay.

    The covenants are on the LR registration. If you don't have a copy, three quid will get it from the LR. Then just state the truth...

    The truth may well be that they have been, however.

    Email cssupport@nhbc.co.uk and ask for a replacement.

    If it's been lost, it's been lost. Not so easy to get a duplicate, but the property wouldn't have been signed off as meeting building regs without it. If they don't like that, they can commission an electrical survey at their cost.

    This should all have been obtained by the solicitors who acted for you when you bought - have you checked with them whether they have the info archived/still in the file? Or (less likely these days) may be with your lender.

    As above, easy to obtain copies of NHBC and council consents if necessary.

    I've got a huge pack from a different solicitor when I moved in. Might be better off asking them.

    Have another careful check through the huge pack to see if the paperwork you need is in there before you ask the solicitor. You may have missed it when you first looked through - I assume you have already looked through them?

    You should be sending these via your sol not direct. If you don't have them, tell them you don't. They will ask for an indemnity if needed.
