Parking Eye Fine

                    I received a PCN from parking eye on the 8th april stating that I had parked at a holiday inn for 2 hours 19 minutes without paying for parking. The truth is in fact I dropped some people off for an event at 21:52 and returned at 00:12 to pick them up. They have only produced photographs of me on the 2 occasions not the 4 which they should have on their system. I appealed to them and they turned me down !! I then appealed to POPLA and yesterday I got that refused as well. What happens next? They are saying that I did not produce evidence that I wasn't there for the said time, but all I did was come home and watch tv for a couple of hours. the fine is now £100 but I am not going to pay as I am not in the wrong. they state that their cameras are 99% accurate!! but that is not 100%. Any thoughts would be welcome  thank you..

            It is not a fine.
This is known as double dipping and is very common because ANPR technology is not fit for purpose. It is a lot less accurate than 99%; only 50% in your case. The UK Government has prohibited its use by local authorities and councils for car park monitoring, but private companies use it because the flaws generate an income for them.
I'm assuming you didn't come here first as forum assisted appeals have a very good success rate.
What happened when you complained to the hotel? Did you appeal as driver or keeper? Hopefully it was the latter.
All you can do now is wait to see if the scammers issue court papers. Unfortunately this is highly likely but again, this forum has a very good track record.
The PoPLA decision is not binding on the motorist and you are not required to pay unless a judge tells you to.
Your best bet is to hammer the hotel manager and demand this charge is cancelled. Leave negative feedback on their website and social media if they won't cancel.

            Complain to the hotel and don't take no for an answer. Use TripAdvisor and the such like if you need to. Also get the people you gave a lift to complain.0

The infamous "double dipping" scam operated by PE.
POPLA know about this scam so it seems you unfortuntely had
an ignoramus assessor which is not uncommon with POPLA
ANPR is not reliable as has been proven many times
By PE telling you that you were there for 2 plus hours when you were not tells you their ANPR is not functional and is flawed
PE need to provide the logs for the day and it is up to them
to prove their claim to warrant the charge.
PE have always been shy to produce logs. If it went to court and they have failed to provide the logs, then a judge could instruct them
If this was me, I would gather my friends that were dropped off,
go firstly to the hotel manager on mass and ask why they
are employing scammers using known ANPR faults.
Point out that any further business to that hotel will suffer if this ticket is not cancelled.
Some managers of these hotels are not up to speed so you may
end up going to the CEO
No doubt the CEO will already know of this problem.
Stick to your guns and demand it is cancelled
There is the option of warning others about the parking scammers
at this hotel by using Facebook and Trip Advisor0 -

he can cancel it
You need to advise the manager that the hotel is responsible
for the actions of their agent and if this goes to court, you will
have to involve them0 -

Hope the event's organiser can sort this for you, but it is the Holiday Inn who contracted PE in, not Indulgence. In the likelihood of Indulgence being unable to help, its time to go to the CEO of HI (in writing) and tell him how unhelpful his manager in Basildon is being.
If you/your friends are regular HI customers, tell the CEO that there will be no further custom if this is the way HI treat you/them. If you've (they've) previous receipts or booking references from HI usage (Basildon or anywhere else), attach copies to bolster your case.Please note, we are not a legal advice forum.             Involve Indulgance Events again leave bad reviews if necessary. I took a quick look at their website but couldn't see anything about overturning tickets. Was this on Indulgant events website or another website you saw this?0
