Old salary cheque

Hello, I went trough old payslips and found cheque (didn't have bank account at that time) dated 11/12/2015 i tried to contact the recruitment agency which is still working but they are ignoring me, didn't try to cash it in bank yet. Just wanted to ask if i can still get money even when they won't reissue the cheque or if i can do something to get the money because i lost my job and the cheque is 200 pounds it would help me if i could :)

    Is the money legitimately yours? If so, you have 6 years to claim it, so until 2021

    Just cash it. At least then you will know if the Bank will honour it.

    I doubt very much the bank will even let the OP bank it.

    OP have you rung them? It's harder to ignore a phone call than an email.
  • I got a reply today : I am afraid I am unable to help you. There is a 3 months window when an employee can raise a query relating wages.
    so is it lost? I will try to cash it but i doubt they will let me, can they verify it somehow if its the same bank? the cheque is from lloyds account and i also have lloyds bank account

    A cheque is just an instruction for the Bank to pay whoever it is made out to. The fact that it is from one Lloyds account to another is irrelevant.

    I doubt you'll have any luck with this if the Agency refuses to re-issue the cheque, although you are well within the time limit for presentation of the original one.

    Just Bank the cheque and see if its honored.

    As I already said, you have 6 years to claim it. That is the law.

    Cheques are only normally valid for 6 months, so if the cheque itself is from December 2015 then it is probably no longer valid to be cashed. However, what I think Guest101 is getting at, is that as this is money owed to you, from the last 6 years, you may be able to argue the money owed is not subject to the limitations act and try to pursue it under that idea. The 3 month rule they have given you sounds like it is their own policy on the matter.


    I would suggest you contact ACAS 0300 123 1100 (who are an employment specialist) to discuss different tactics in re-approaching the agency and trying to resolve this amicably - if you can. Your other choice, if it can't be resolved, could be to consider legal action in order to recover this money. However, you should get some legal advice before you go down this route. Good luck,

    "In-line with industry best practice, cheques that are paid into or written from your account are usually honored for up to 6 months. However, although they’re honored for up to 6 months, they’re legally valid for up to 6 years."

    The cheque is a promise to pay an amount that had already been agreed, and that promise hasn't yet been honoured ; you aren't querying the wages, so their time limit doesn't apply. They've had an interest-free loan off you.

    Get someone else ( ideally also with Lloyds ) to write you a check for a few quid, dated 11/12/2015, and crumpled a bit, and try to pay it in. If they refuse, you can find out their policy, and have a discussion if necessary to understand it. If they accept it, you can try to pay in the £200 one.
    Maybe the policy is that they contact the drawer, and ask if it's OK.
