    This certainly sounds unusual for a tenant to be building (and financing) an extension!
    Normally a 2 bedroom unit would pay a far higher proportion of the service charge than a 1 bed unit often double - I would imagine re-writing the leases would involve considerable legal fees.

    Not sure what you mean by tenants. i own my flat and the garden. My flat own the 25% of the freehold. 300 quid as we had to change lease last time someone own £1200 when sold the flat. Now flat can't be sold unless they up to date with the ground rent and management fees.

    Tenants are the people that have the leases on the flats - you would call them the owners of the flats, but in law they are tenants with a (very) long lease. The landlord is the group of you together that owns the freehold.

    So the question is whether the "owner" of the new larger flat should pay a greater share of the service charge. Also if the flat (?) roof of your new extension needed repairing does the cost come from the service charge or from you individually? This is the sort of thing that would delay a sale.

    I'm curious whether building regulations require you to have foundations deep enough to support a 2nd floor on your extension? In a house, that would be a requirement for anything being added, not sure if it applies in your situation. When you come to sell you will need planning permission (if relevant) and building regs sign off.

    Yes understand that could delay the sale! Don,t think it be an issue as we agreed last year to add landlord insurance onto the freehold buildings insurance and we don't need it but pay for it! Personally if the flat roof need doing I would pay for it to be repaired but I assume when come to sell I might have to stat this!
    Basically we pay into the management company 50 quid ground rent a year and 30 pounds a month maintence!

    No can,t be built 2 storage high as the extentions is 2 x bedroom. So main room will have a dome as 2 out of the 3 walls will look into someone else garden! Third wall is the wall separating the bedrooms. Also the landlord above enquiries and was told it not passed planning.

    We have planning permission and building regs all done!!
