Regardless of whether anything is written down or not when someone pays rent to the landlord (a landlord who does not also live in the property that is) an Assured Shorthold Tenancy (assuming this is England or Wales) is automatically created.

The landlord has been sloppy, you and the others who remain in the property have been naive, and the one who collected the deposits has or is spending your money.

Surprisingly I just received a phone call from the first person (who has vanished from the house and was responsible for everything). He said to me that he paid my deposit to the real landlord. He also said not to pay anything to him, stay one month and leave the house. The owner of the house is coming in 1 hour. It will be interesting to hear what is he going to say.
