Capquest - a quick question

    I received exactly the same letter last week for an old littlewoods debt and the deadline was the 2nd of Oct..........I have just ignored it so far but the letter that phatbear posted looked very good..........it would be good to know what reply you get and I will let you know if I get anything further

    Sorry lolly for jumping on your thread - just thought I would pick up on what phatbear had said, this happened with me sent the CCA request to one company, everything removed off credit file but then received a letter from Capquest for the same thing, (minus the £1 CCA request fee) looks as though they've passed it on.

    Trouble is i'm now receiving phone calls from them, had a particularly nasty call with them today (nothing admitted from my part) but not too sure on where I stand, do I need to do a CCA again to Capquest although they said today that they don't own? I just advised that if there WAS a debt I wanted to ensure that I was paying to the correct people?

    Didn't mean to hijack the thread but if this is the way the agencies are carrying on I think it's perhaps right to clear up exactly what OUR rights are from the outset instead of people just being bullied.

    I have had a reply from Capquest saying that my account is on hold for 10days until I send them a £1 fee (I forgot to put it in!!) - so will keep you posted.

    Hello me again.

    I am still waiting for my CCA from Capquest and because of the post strike would imagine it would be late arriving. I have just checked by Equifax credit report and they have recorded the debt on there as a default! Surely they cannot do this yet until it has been decided if it is me or not?

    Is the default entered by Capquest or Littlewoods ?

    If it is entered by Littlewoods then you need to CCA them too - send exactly the same letter and £1 payment and make sure you send it recorded delivery.

    If it is entered by Capquest, then you have to wait for the 12 working days plus 2 for postage before they are in default by not providing a CCA. At this point you can stop payments (if you are making any that is). You then have to wait a further 30 calender days before you send the next letter which basically states they haven;t got a leg to stand on and you require the default removed from your CR. If they are unwilling to do this then they need reporting to the relevant bodies, namly TS, OFT etc etc but we will cross that bridge when we come to it :)

    Again, stick to the timescales regarding CCA ing Littlewoods, you are really just covering all lines of debt collection as you may well find that if Capquest cannot produce a CCA (highly unlikely given that its a catalogue debt) they will just pass it back to Littlewoods who are then likely just to pass it on to another DCA and you then have to start it all again.

    Take no notice of the threats - they are empty and keep all correspondance you may get from them as this will help your case in reporting them and getting the default removed.

    Weller711 - thanks for responding. The default is Capquest and not Littlewoods! I'm still waiting for the CCA to arrive. So once I get that I will be in a better position to deal with this.

    If they cannot provide the CCA do they then take the default off of my records? x
  • Thank god i found this site. CrapPest have been hounding me for a Littlewoods debt i never had. my EX Girfriend i lived with used my name to obtain goods. They said its my debt and i must pay. I have never signed nothing regarding a credit agreement. neither any goods. I was working long days at the time and was`nt at home to receive or sign for anything..all done behind my back.

    Over the last few months been paying them off monthly and now they say i have defaulted on the monthly payments beacause the last payment was a day late. Now they say i must pay the debt in full, or enter a new payment of more per month.

    They have rung me many times and now asking for a expendature details of my income.

    I have had a Letter from HL legal too.. demanding a final settlement payment.

    Any advice welcolme.. and hello to you all..firstly and reading lots here too..
