    Did you exchange contract already? For, if you done this it will only mean that both of you are legally committed to sell(on your part) and buy (on his part) your house.

    From what I can glean you have yet to check the registered details to confirm who the legal owner is and whether that ownership is restricted in some way - you can check for £3 online and that may relieve some of the stress as you are not then reliant so much on what you are being told.

    You may also wish to check if probate has been granted although it may only be required to deal with your late Father's wider estate and not the actual property, if your Mother was a joint registered owner.

    As others have posted the 'interest' is in your late Father's 50% share in his beneficial ownership, namely half the current value of the property.

    The legal ownership, which reads as if it was in their joint names, is a separate issue and may or may not influence how you release your 50% share in the property's value.

    If they were joint owners then the legal ownership has passed to your Mother. Probate is not needed for that aspect and any change to the legal ownership would only be achieved by her transferring it's whole. That could for example be to her and her new partner.

    If it was changed to her and your joint names then you have more leverage as any subsequent transfer would need your involvement. If it wasn't then you are really in your Mother's hands as to how swiftly such things are resolved.

    If you can clarify the registered details then I am sure posters can ease the stress to some degree as we will have a better idea of what propbably needs to happen next

  • I wish I could give you all more information the confusion you all have with it is the same I have with it from the day my father died. When my father passed away I signed a contract of some sort that said I would receive 50% of the house. (I will dig it out tomorrow and let you all know officially what it was) My mum I'm certain has probate and that the house in which she lives in was a joint home i believe. My mums very secretive when it comes to personal stuff. It gets on my wick too because I ask stuff to know, not to be nosey. But anyway.
    I apologise if I sound slack but I really have no idea. I can't get the answers in need of the internet. And I ask the people that's dealing with it. (I.e mum, partner) and they say they know nothing. Yet it was them who went to the solicitors. The solicitors won't speak to me as it isn't my case. Fair enough. Confidentiality and all. But I'm not asking for information all I need is dates and processes. It will be 2 weeks as of Friday when she visited if that's any conciliation?

    Heaven knows what you needed to sign - that doesn't sound like anything connected to a will.

    If your Mum has probate, you can buy a copy of your Dad's will and see what it said.

    Have you checked the ownership of the house on the Land Registry?

    Natcrystal checking the registered title is open to all so I am unclear as to why you are unable to get that specific answer off the internet? I suspect you mean general advice re wider issues but is there a reason as to why you have not checked the register online yet?

    If you email me at customer.service@landregistry.gov.uk with the property details I am happy to take a look and then post a general answer here as I think that will help. If oyu don't think it will then let please post accordingly

    If you need the actual details then you would need to obtain them online for £3 as posted earlier.

    But to help others offer some specific advice, at least around the property, it would help to clarify who is registered and in what way
