Ex Partner With Late Payment On Credit File

Hi All

I have split up with my ex partner for 6 years now and I have got a mortgage with my ex partner but she doesn't want to sell the property and she says that its not a option as it's 50/50 joint mortgage so we are renting it out. She has made a few late payments on the mortgage and is showing up on my credit file and damaging my file, is there anyway I can not have these show up on my file as it's not my fault as I've paid every else in time?

    Unfortunately no, the mortgage lender is reporting the actual state of the account, irrespective of who makes the payments. The financial link between you and your ex for the account (you have joint liability) means that it will show on your file. You could put a notice of correction against the account (needs to be done for all CRAs that report it) explaining the situation, which lenders will see when you apply for credit but it does not mean they will factor this into their decision process.

  • Thanks for your help! She is sorting the mortgage payments which go into her account can't I prove this? There were 6 late payments in a row which she made and it's affecting my credit really bad as these are the only late payments on my file. I understand that it's a joint mortgage but if she is dealing with the payments, there must be a way for other lenders not to see this as I'm not in control.

    It's a joint mortgage so of course you are in control. If your ex is failing to make the mortgage payments on time then why not arrange for the payment to come out of your bank account instead?

    If you are renting out a joint property I'm totally failing to see how selling it is not an option.
    You could force her to sell if you wanted to.It would involve a solicitor and psossibly court but for a trashed credit file it might be worth it.

    Have you discussed her taking a sole mortgage and buying you out the property so you no longer have any liability for payments?
    Whilst you have a joint product the lender can look to either party for full payment....so the fact that payments were late will impact both your records
    Do you each declare a % of the rental income/profit for tax purposes?

    Its a situation (in hindsight) that should have been dealt with at the time of seperation. Each party to the mortgage is jointly liable for the repayments no matter what is agreed between you both. No way around it I am afraid.

    Force her to sell the property. She has no defence if what you say is true. A solicitors letter may focus her attention as to how seriously you are viewing the situation. May cause a change of mind even. Without you needing to follow through on the threat.

    She is keeping the rental profit which is completely wrong but I can't change the bank account for what the mortgage is paid into as I need her say, the house went up for sale and we had a buyer but at the last minute she backed out then it all fell through so I am in the same position, I don't understand why she want just sell it? Its affecting my credit really bad but nor banks or herself want to do anything and I haven't got the money to pay solicitor fees.
