Oh, I'm still within the appeal window. But, like many people, my knowledge of dealing with such matters was hopelessly out of date and I also explored some avenues (Private Parking Appeals) without doing due diligence.
Still not sure my prospects for a successful outcome are especially high, mind.0 -
excellent , at the moment the drivers actions will remain secret and for now they are immaterial as one of many appeal points is clause #13 of the BPA CoP , which has 2 parts , one before and one after
so a possible 10 minutes to park up , read the signs and obtain a paid for ticket, plus over 10 minutes to leave once the parking period has been paid for , so a possible 20 minutes allowed plus the parking time paid for ,which is greater than the period that the entry and exit times add up to in total
if you had READ clause #13 of the BPA CoP, you would know this0 -
A purely hypothetical question here - but what does one do if the parking company say you never bought a parking ticket, you are adamant that you did, but don't have the ticket any longer to prove it?0

Your word against theirs - unless they have documentary proof like a list of car registration numbers (where motorists have to input their VRM at the point of purchasing a ticket) at the approx time of the parking event - and your number isn't there. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

And is that something that one is able to request? Should that be done at appeal stage or POPLA stage? They have to prove their case to POPLA, so you put them to strict proof on any appropriate points you wish to raise. Please note, we are not a legal advice forum. Just because the scammers provide a list of VRNs to PoPLA where yours' doesn't appear, it doesn't mean a ticket wasn't purchased. It is impossible for them to prove a negative.I married my cousin. I had to...I don't have a sister.
