Morning,
I got my self into a bit of a mess with parking tickets with Euro Car Parks.
The first I knew of the tickets was when i received a debt letter from debt recovery plus asking for £160, i contacted them and they threatened further action. We are due to apply for a mortgage soon, so i was worried about anything affecting my credit rating so paid it.
I then discovered by chance after checking my RTS post in my apartment block another ticket to my address in the wrong name. Which has now been passed on to debt recovery once again as i missed the opportunity to appeal as i didn't receive the letter.
After checking with the DVLA there was a slight error in the way my name was given by the trader i brought my car off and he had left a gap between my name which is why there was a mistake with who they were writing to.
I used a paybyphone app to park my car, on 2 occasions i made a mistake in my rush to get to work and clicked on my wife's registration plate as we alternate cars. So i had a actually paid to park a car registered to me for the days i received the tickets and have email receipts for the days in question.
No one will talk to me now, I cant appeal through POPLA as i cant get a reference number as i have missed the appeals process via EuroCarparks and the debt collection company arnt interested.
What can i do?
Thanks in advance

You do what you really should have done when DRP got involved in your first ticket - ignore it at debt collector stage. Both tickets could have so easily been successfully appealed at POPLA, but you're now well past any appeal stage. You were mugged first time around, don't get done twice in a row.
Only if ECP (not DRP, they can't) took you to court, you lost, the judge awarded costs against and you refused/failed to pay, then it might have some effect on future borrowing.
You've fallen for the great urban myth about credit ratings!

These "fines" are usually cons, and thrown out by judges. If these are residential tickets, it is even more likely that they have no authority to issue tickets, and, if it got to court, depending on the wording of your lease/?AST you would probably win.
You need to make strong representations to your landlord if a tenant, or your MA if an owner. Judges are, more and more, finding for occupants who are being hassled by these unregulated scammers..You never know how far you can go until you go too far.0 -
Hi, Thanks for your input, I couldn't appeal thorough POPLA as Euro Car parks had passed it straight to debt recovery which meant i was unable to get a unique reference code to appeal.0

Did you send an initial appeal to ECP? Did they respond to it?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I couldn't send an appeal to ECP as they had my name wrong from the logbook so i didn't receive any correspondence which meant i missed the appeal window and it went straight across to DRP0

Is your name and current address correct on your V5 (logbook)? Or have you moved house in the past few years and not updated the DVLA.
Just getting your name wrong should surely still have seen the letter being delivered to the correct address? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
