At the end of the day I will apologise like I have done already until I'm blue in the face, I did not start the argument, I attempted to follow the correct procedure and reporting the assault, The fact I said to my manager "this is bull***", does not account to gross misconduct. The fact I was shouting and crying does not account to gross misconduct, I fail to see how any of my actions account to gross misconduct.0

You argued with a member of staff in front of passengers - GM (regardless of who started it, you're not at school)
You showed your behaviour by continuing to shout and cry in front of a manager - GM
Just because you don't think it is, doesn't mean it isn't.
Correct procedure would have been: "this isn't the time and place fellow colleague, let's go to the managers office and discuss our concerns in private with senior management'0 -

Ah ok I see the confusion, we did not argue in front of passengers, we were in our break room well away from any passenger accommodation.0 -

And senior management were well aware of the issues between me and my colleague, however they did nothing to separate us.

Ok let me go into more detail. Me and the colleague in question had a one night stand in November. From then until now I have received constant abuse from her other half, she has threatened me with violence on more than one occasion, I have spoken to management regarding this and in my company, they move you to another boat, I have acted professionally for 5 months, everyday being called a rapist by her and her other half, she fell pregnant and shes been spreading malicious rumors that its mine when its biologically impossible to be mine due to the dates not matching. One minute its mine and the next its not etc, put yourself in my shoes and tell me how you would cope with that going on day after day and managers not doing anything. Friday was the final straw for me and I got angry!! not an unreasonable reaction to again what I would call crap management. I DID NOT start the argument on the day in question, I was upset and angry at how I was being spoken to by someone on a power high.
It was explained to me that they are investigating my conduct, which was me saying bull*** and shouting, which yes is misconduct but not gross misconduct. I am happy to admit I acted unprofessionally and is the first time in 9 years of constant employment this has ever happened. The manager in question has accepted my apology.0 -

All of that is very distressing to you I can imagine.
However, it does not stop them dismissing you. You have committed gross misconduct. The fact other people have doesn't negate that.
Personally I would never allow myself to be alone in a room with someone who had consistently in your words called me a rapist.
If the company has kept you together then you need to question why you want to stay with this company.
And again. Call the police. She assaulted you. Has accused you of rape many times. Put your money where your mouth is and file a claim for harassment and verbal abuse. If she has a restraining order the company should have to separate you.
But overall, of all the above is true, you need to get the hell out.0 -
Do you have any evidence as to your colleague's behaviour towards you, and were your requests to management to deal with it verbal or in writing? Basically, if you want to show mitigating factors, can you prove it or can management deny it?All shall be well, and all shall be well, and all manner of things shall be well.

I finally got in touch with the police last night and make a report for harassment, I would love to leave, however I do not want to reply on the government for handouts and I really kind of need money... you know... to survive? I am a little confused as to how me swearing once constitutes gross misconduct?0 -

"Getting in a heated argument" with a colleague is gross misconduct.
"Shouting and swearing" at colleagues and managers is gross misconduct.
You didn't just 'swear once'0
