    That is assuming the Aviva fund forms part of your late sister's estate and is not nominated in favour of anyone on trust. Have you contacted Aviva yet to confirm about the terms of the fund?

    Yes, this does seem the likely outcome, and it really delays and complicates things. Lose-lose situation really. I'm sure he won't have left anything in his will to me anyway.

    Ironically, Aviva have a record of my sister phoning to nominate me but as she apparently never filled in the form they subsequently sent, then the intestacy rules apply.

    If the estate does have any funds then the funeral costs take priority over any other debts.
