HELP! Received a court claim today
Forren
Hi,
New to this forum. I was sent a letter around a week after I'd been to Burton hospital when my new born baby was taken back in due to complications with her breathing/heart. I was parked in the carpark overnight and completely forgot to pay on the way out due to the circumstances. Strangely the original letter stated I was in the car park for one hour?
I received all the letters and just ignored them, this morning I received the court claim letter. At a loss as to what to do now. Have I gone about things in the wrong way by ignoring the letters?
I appreciate the search function is a tool to be used and have looked, however felt the need to start my own thread.
Thank you for looking

1. Read the NEWBIES FAQ sticky, post #2 which tells you how to initially deal with the papers you have received.
2. Complain to PALS (Patient Advice and Liaison Service) at the hospital, explain the details and ask them to help you get the charge cancelled.
3. ParkingEye by chance? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Yes Parking Eye, apologies should have put that in the original post.
Okay will look into your advice thanks for replying0 -
Also, write about it on the Hospital Facebook page, and inform your local newspaper, complain to the trust, and your GP
People should not be hassled thusly when in the midst of a medical emergency. You never know how far you can go until you go too far.0 -
Sent a complaint to the PALS at the hospital. Have I left it too late?0

Too late as far as 'just getting it cancelled', perhaps, but don't let that stop you! Under the circumstances I would have complained MUCH earlier and you should do so now, very assertively not an appeal, a MAJOR complaint to the CEO of the NHS Trust (by name, look him.her up and fire off a significant complaint in no uncertain terms, telling them how this has affected you and the distress they are causing.
How DARE the Hospital Trust allow this? Get angry about this:I was sent a letter around a week after I'd been to Burton hospital when my new born baby was taken back in due to complications with her breathing/heart. If you complain enough, it might still be cancelled or PE might say they will settle for £60, in which case, tell the NHS to pay it. Not joking. The NHS Trust are in breach of Government policy and you really should have had this cancelled ages ago:
https://www.gov.uk/government/publications/nhs-patient-visitor-and-staff-car-parking-principles
Also copy in YOUR OWN LOCAL MP right now, to everything you send. PE's legal 'Team' (shame on them) email is:
enforcement@parkingeye.co.uk
Is it too late to defend? If they will not cancel after you rattle EVERY cage you can? No, not too late.
YOU MUST ALSO ACKNOWLEDGE THE CLAIM AND THEN DEFEND.
Hopefully you have now read the NEWBIES thread post #2, which is there to walk you through the acknowledgement & defence, and then WS & evidence for your hearing. We do win - 99% of the time, we see them off.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi all, after my complaint to the PALS I received a phone call from them today and gave them the ref number for the parking invoice etc. They said they would pass on to the parking office. Got a call back saying that they'd spoken to Parking eye and they are cancelling the invoice.
Thanks for the help0 -
There you go. Well done. Have a great holiday weekend.
Hope your baby is well and now over her complications. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
