UKPC - Lost Appeal Rejection

Firstly, I have reviewed the newbie thread, but could not find an answer to my particular query. I hope you can help.

I received a PCN from UKPC on my windscreen Christmas 2016, when parked in a visitor bay in the residential car park of my apartment. Grounds was overstaying a 24hr period. I ignored the PCN and then received from my lease company (as its a company car) notification from UKPC to advise them of registered keeper (UKPC had evidently gone to DVLA). I advised the lease company not to pay the fee, and sent my details to UKPC to stop them contacti my lease company (who would have paid the charge). I appealed via UKPCs website. I didn't hear anything further believing my PCN was under appeal, until DRPlus contacted me out of the blue demanding payment. I advised them by letter and email that my PCN was under appeal with UKPC and thus they should not contact me further. I also advised UKPC by letter that they needed to respond and the 35 days in which they should had lapsed. UKPC said nothing, but DRPlus then sent by email a copy of what they claim was UKPCs rejection of my appeal, stating I'd also now missed the opportunity to cascade to POPLA. They advised me to raise the issue with my postal provider if I hadn't received anything! I then chose to cease any correspondence as clearly it was getting me nowhere.

My question... is there any point in contacting UKPC and asking them again to cascade to POPLA, or am I wasting my time? What's the best course of action where I currently stand? I haven't raised with the apartment & grounds managing agent yet (they're also a bunch of cowboys) but can try this.

Incidentally, a family member also got a ticket in the same car park, and also hasn't received a appeal rejection letter within the time period of 35 days. Big coincidence?

I plan on selling my apartment later in the year, so will need to tell all parties. I haven't included details of my appeal (perceived breaches of BPA code of practice) but can provide these if relevant.

    Complain to the BPA and copy in the DVLA, but you're up against a bit of a brick wall. Come back when you get responses.

  • Thanks. I tried that already. BPA responded saying operators aren't required to send post by recorded delivery so there's nothing they can do.

    Why can't they get UKPC to issue a new POPLA code in the pursuit of fairness. It doesn't cost UKPC anything.

    Not being required to post by recorded delivery is a side issue (aka 'an excuse'). Ask if they are calling you a liar? If they're not, then they can get hold of UKPC on your behalf.

    Tell him it's in the public domain that there are numerous cases where UKPC's rejection letters are never delivered, so many that the BPA should be instigating an investigation.

    If the charge is a fair one, UKPC should have no fear of POPLA, because if it is fair, then they should win!

    Copy everything to David Dunford at the DVLA.
