    have an appointment arranged for 2moro with a solicitor specialising in employment law.
    am not a member of a union - as before i was promoted i was the local rep as soon as i become management my boss is also the union rep !!
    now not in a million years do i think that is right, so refuse to pay the £16.28 a month they want.
    have done some research today and checked out my contract which has no references to bankruptcy.
    but i will try and keep this post informed of the outcome as it may be valuable in future for other bankrupts.

    On the other hand, maybe if they'd not paid you a cr4p wage, you'd have not been in this position :)

    no pastures - they pay me very well.
    my situation developed from the breakdown of my first marriage.
    at the divorce the judge kindly assigned all joint debts over to me as my ex said she was not aware of them - even though the statements would suggest i was a crossdresser as £14k was run up in womens clothes shops !!
    but lets not go there thats water under the bridge.....:mad:
    during the breakup i was trying to keep my responsibilities by paying mortgage on the old marital home and looking after kids, as well as setting up a new home for myself - the lure of the easy money on credit cards prooved too easy.

    the last thing i want is to set off on a new career, if this was to be the option then i would definately leave these shores.

    Good for you. I dont know whether what ther're trying to do is legal or not - but it sure as hell isn't morally right!

    Id just like to say that not all employers do view BR so negatively as others have assumed.

    I was quite worried about this as i work as a TA in my local school and also run some after school clubs - i often work with money both collecting weekly subs and controlling budgets. I discussed everything with my boss and was very open (luckily we have a good relationship anyway).

    I was also worried about how some parents may react if they saw it in the paper and again discussed this with him - he calmly replied that should anyone query my ability he would very politely inform them - it was none of their damn business! My role at work has not altered one jot and i am still responsible for after school budgets!

    All the very best boogie you are just as capable of performing your job whether or not you are BR - i get very annoyed at the supposed idea that because we are BR we are either inept at dealing with money - or thieves!!!!

    I have worked in different industrys over my 30 year career, I am qualified in Management, HR and Training.

    I only offered advise to this person not to you, funny how you made a point of persecuting me and bringing quotes onto this query with absoultey nothing to do with BR, one of my quotes regards basic canned goods for goodness sake.

    I'm not persecuting you at all; if anything you were being a little harsh on the O.P.:eek:

    Maybe I'm overly defensive of people who find themselves facing bankruptcy
    and when people start to talk about "stigma" and trotting out phrases like "vicarious liability" it makes me wonder about their true motives.:confused:

    Some of the comments you made were helpful :A but there was a heavy dose of judgement mixed in.:rolleyes:

    I was rather hoping that you were a union officer or a solicitor and the only reason I looked back at your previous posts was to see what you had to offer the O.P's situation.:D

    It really doesn't matter though; the O.P is taking legal advice and not considering redundancy; that's just what he should be doing.:beer:

    well the legal advice is sit back and see what they intend to do.
    bearing in mind i work for the goverment, the advice i received is that they are acting unlawful in even expecting me to take a drop in earnings or demotion.
    as for redundancy that is not even to be considered.....

    That must be reassuring for you; it does seem as though somebody has got a personal grudge against you rather than you being in breach of your contract of employment.

  • They could of course leave it a few months and fire you for something else. If they want rid of you there isn't a lot you can do.
