NTK Peel Centre

Not sure if this has been covered elsewhere, so apologies if it has.

We had a NTK arrive last week relating to the Peel Centre, Stockport. The thing is, we didn't buy a ticket when we parked there. It was after 8pm, all the stores were closed, we just went to Frankie & Benny's (cos we don't know Stockport and couldn't find anywhere else to eat) and were parked there for less than an hour. We didn't see any signs relating to parking charges or pay and display at the time, basically because we weren't looking for any - although I have been back and can see that actually the signs are everywhere (!). Also, my wife is in a wheelchair and we parked in a blue badge space. I think we've kinda grown used to most car parks allowing at least some time free for blue badge holders.

Anyhow, having read the newbies thread the advice given seems generally geared towards people who have overstayed the time on a ticket they've bought. I'm just wondering if we still have grounds to appeal even though we mistakenly didn't buy a ticket? Having read a number of threads here and on other forums, it seem that Excel have put some effort into Peel Centre to address points raised in previous appeals (e.g. the number of signs, the size of the words "PAY AND DISPLAY" on the signs, etc) presumably to reduce options for appellants.

    there are literally HUNDREDS of threads on here about the PEEL CENTRE, which has been a pay and display car park for many years (and has been on tv and in the papers many times) - there are no "free" parking spaces at all

    any appeal points will be based on legal arguments , like POFA2012 compliance , signage issues and maybe a few more

    doesnt matter what grounds you appeal on , EXCEL will reject your appeal , but if you are appealing then use the IPC template from the NEWBIES thread , as keeper

    and do not reveal who was driving

    after that its stalemate for 6 years unless they issue an MCOL (which they do , a lot , so they keep STOCKPORT court very , very busy)

    use the forum search box in the drop down menu to research the place , using PEEL CENTRE STOCKPORT as possible search phrases

    your predicament is no different to that of hundreds or thousands before you and parking prankster , watchdog and ripoff britain have featured it

    and the BB isnt valid on a private car park, but the EA2010 is

As I said, most things seem to be relating to cases where someone has overstayed a parking ticket they've bought, but we out of ignorance didn't buy one at all. We weren't trying it on, we just haven't come across this kind of situation where we live in the Derby/Nottingham area.

    Presumably the only grounds we'd have for appeal would be on the basis the £60 charge being excessive?

    no , the BEAVIS case threw that argument out over 18 months ago

    legal arguments are

    poor and inadequate signage
    NTK failures
    POFA2012 failures
    IPC CoP failures

    etc

    We've seen loads of Peel Centre threads about people not seeing the signs, not seeing the hidden P&D machines in the corner. Often people at Frankie & Benny's, so that corner must be badly signed, IMHO.

    Try complaining to Frankie & Benny's and to the Peel Centre, as shown in loads of threads where the Peel Centre have actually cancelled PCNs.

    But we are NOT telling you to pay. Do exactly a the NEWBIES thread tells you, which is to complain to the landowner/retailer (for an early cancellation) and to appeal using the template for IPC members.
