Insurer refusing to provide no claims.

Need some advice.

Parents were insured with Dad as the policy holder and main driver, but they had over the years switched policy holder with the same no claims. Dad just preferred to do it that way. They have not had any issues swapping the policy holder and no claims.

Dad passed away last year and the insurer initially said they will have to cancel the policy. I spoke to them and said your joking right.

After some muttering in the background and being put on hold for a while that came back and said they could transfer the policy to Mum.

No renewal received with the policy due this week. She contacted them and they still had Dad as the policy holder.

Now they are saying she doesnt have any no claims. But if she insures herself with them for the coming year they will hand her no claims back. This sounded a bit like being held to ransom to me.

Especially as their quote is considerably higher than comparison site quotes starting with zero no claims.

Has she lost her no claims which she earnt most of, because Dad had use of the company vans. It was only when the vans were assigned to jobs rather than drivers that they transferred the policy into his name.

Any help?

Thanks

Only the policy holder earns a no claim bonus. The named driver does not.

Some insurers will credit a named driver with a bonus as a concession but it is not transferable.

This appears to be what your mother's company are doing.

Was the policy ever in her name? and if so when was the last time she had notification from insurance company stating what no claims bonus she had? If it is minimal and there are cheaper quotes then decide? remember cashback sites.

I have read on here previously that most insurers will transfer a NCD on death of one spouse to the other. Perhaps if you tell us which insurer it is someone might know if they do this, or if they are one of the ones that don't.

They have transferred the policy between them several times over the years.

The no claims would have been mums originally, but that was quite a while ago. They did transfer it back and forth a few times. Only ever the one car and one no claims.

Dad had the company transport and mum needed to commute so it went back into her name. Then he changed companies and transferred it back to him. Then he got another job with transport and it went back to her.

Before he retired the firm he was working for assigned vehicles to jobs so he couldnt rely on having a vehicle. So it was transferred to his name again.

No idea why he did it that way? He could have just said im the main driver now. Its been a few years since mum had the policy in her name and unlikely to have any paperwork at all.

Some useless broker that takes 40 minutes to answer the phone it seems.

Not sure on the actual insurer. She has not received any renewal paperwork at all.

They still have dads name on the policy and even asked for him even though we contacted them last year to notify them of his death.

The company are willing to transfer the no claim bonus to a new policy with them.

Transferring the no claim bonus within the same company is different to providing a no claim bonus credit that has not been earned by the named driver to a new company.

She doesn't have any NCD, so they are correct in saying that.

They aren't holding her to ransom - they are offering to swap the NCD to her! The problem you have is that the policy was never changed over to her after the death of the policyholder.

So worth trying a formal complaint about that (if it was the insurers fault) if you don't want to take up their offer, though she has no "right" to her getting proof of NCD in her name.
