My husband had an accident on his motorbike on Thursday - it wasn't his fault someone pulled out in front of him. He now has a broken collar bone. Now I have never had a motor accident so I don't know how this all works. However he has legal expenses cover. He rang up and told the insurers about the accident and I assume they will collect the motorbike and assess it then either repair or write it off. They asked if he had any injuries and he told them and they passed him on to their Personal injury claims partner. We have been sent a 28 page form from the Personal injury 'people'they are 'paralegals' not solicitors. Does he have to use them? Can he use an alternative of his choice? They were pushing for him to sign the form straight away, but what if there are complications with his injury? how do you know how long you will have off work? He has to go to hospital tomorrow for an appointment at the fracture clinic and will have to get a taxi as he can't drive - this will cost £50! Will he be able to claim that back ? Any advice please.

He will be able to get back all his out of pocket expenses as well as compensation for his injuries etc assuming there is a liable (and insured) third party to claim from.

He is not tied to using his insurance companys associated injury solicitors

He may wish to consider using an Accident management company rather than his own insurer and claim everything directly from the third party including his repairs

He needs to keep all receipts, starting with tomorrow's taxi

Thanks for your reply Quentin, good to know that we can use another injury insurance solicitors as the one the insurance company referred us too doesn't seem that good, trying to rush us too much without explaining things properly. I will have a look into accident management companies - would this be an alternative to going through his Insurance company for his motorbike as well as Personal injury?

    Yes. .

An AMC would deal with the third party insurer directly and pursue all aspects of the claim including repairs/costs incurred/injury compensation/ loss of earnings etc

(Beware any PM's you may get from lurkers here offering to act for you)

Quentin, who would pay the ACM? Would the bikers insurance company pay ( if he had legal expenses cover ).
  • What happend to you? how long did it take did you get pay out?
  • It takes forever. Accident happened in May, the insurance for the bike was settled Aug/sept, the personal injury claim is still ongoing.
