SCS law Parking Tickets from Premier Park Ltd.

Hi all,

I have recently a 'letter before claim' from SCS law, regarding some private parking tickets I received back in February and March of 2015, for parking outside a complex of flats. Each of the three amounts to £165, so £495 in total.

I will attach the three pages, but to get to the gist of this, they are threatening Court Proceedings against me should I not pay the full amount within 14 days, which may correspond to Bailiff intervention.

For some additional background information, there were no signs up at the time, and I do not believe any photos have been taken of my vehicle. I spoke to a Police Constable about this two years ago, and she said that the individual issuing the tickets had no authority to be issuing parking tickets, and that it would be a matter for the Trading Standards. The individual issuing the tickets was not the Landlord, but instead a tenant.

I would be grateful for any advice on this matter. I am unsure whether to ignore this, or to try and justify my position.

    How are the letters headed?

    Bailiffs can't be involved before you've had a court hearing, the judge has found against you, with costs, you fail/refuse to pay the costs, the PPC applies to the court for a warrant of execution, bailiffs appointed.

    If you get bailiffs at your door - it will be self-inflicted. Don't let solicitor letters panic you.

    But you definitely should not be ignoring these now (until we know exactly what they say) just hoping they will go away.

    You can't attach files here, so host on TinyPic, or photobucket, Dropbox, Google drive or the like, then copy and paste the URL here, but change http to hxxp as newbies don't have linking privileges until they have a couple of dozen posts under their belts. A regular will convert into a live link.

    They are headed with three green squares and 'SCS Law', followed by the address: "level 34; 25 Canada Square, Canary Wharf, London, E14 5LQ.

    They are debt collector letters (DRP) using pimped out SCS letterhead at around £2 a pop. The 'giveaway' is the organisation to which payment should be made - in this case DRP. You can ignore these (file them safely).
    They are headed with three green squares and 'SCS Law', followed by the address: "level 34; 25 Canada Square, Canary Wharf, London, E14 5LQ.

    I didn't mean the name and address header of the letter; I was looking to see whether it was headed 'Letter Before Claim/Action' (or something similar) as that kind of letter would need a response.

    Come back if you get a LBC, or court claim forms.

    Came across this forum looking for advice as I've received basically the same letter. There is a section within the letter, right at the end which says 'Please note that this letter is to be considered a letter before claim for the purpose of the Practice Direction on Pre-action conduct...' - does that mean it needs a response?

    There's no right or wrong answer to this at the moment. As we see it at present, with payments to be made to DRP, it looks like a DRP letter using pimped out SCS letterheads. DRP cannot issue a LBC.

    But this is a new wave of letters only seen over the past few days. If you want to robustly respond, there's no harm, but please let us know the outcome.
