Hi all, I am looking for a bit of advice.
I car reversed into me a few weeks ago, i was on my own, no witnesses, the other driver now claims i ran into his rear, he had a passenger.
Should i chase the claim or what? I have legal protection etc.
His passenger will have to back his story up too.
I have a lawyer from insurance company handling claim.
I just wondered if any knowing person has any advice, it's only a £2000 claim, why would he want to protest as he has insurance.

    Maybe his insurance is third party so, if the accident is shown to be his fault, he won't get a payout for the damage to his car. If he can make out it was your fault, he will get his car repaired under your insurance.

  • Street accident , he stopped i stopped ,he saw parking space and revresed into me, no damage to his. Tow bar, spare wheel and well hard bumper on 4 wheel drive thingy, damaged front bumper bonnet etc ON MY CAR.

    If you make a claim on your insurance you will get penalised in several ways

    You will have to pay the excess.
    Next year your premium will rise because you've had an accident
    Next year your premium will rise because you will have less NCD.

    Some people will lie, but sometimes people have a genuinely different recollection of events biased in their favour.

    Are there any independent witnesses? i.e. not friends, colleagues, relatives etc.

    If there are no independent witnesses then blame is often apportioned 50/50 as it's pointless going to court when it's your word agaisnt someone else's.

    Defnitely you should stand your ground if you believe that you are right.
    You have a lot to lose.
    Unfortunately if you can't prove it then it's difficult to "win", that's why it's so important to get independent witnesses if that's possible.
  • I used to work for a non fault accident company who provide lawyers and hire cars. I see you have a lawyer - is it through one of those types of co's I used to work for??? If so I wouldn't advise any more but if you aren't going through them I can give you the number because if you don't have a claim they won't get involved and believe they're hounds and WILL sort you out!
