PCN In a car park where signage from different companies is displayed

Hello All

Great forum!

I have received parking charge from pcm for my car being parked in Leon House Car Park in Croydon. I was not a driver at the time. It has been photgraphed on double yellow line. But before ENTRY wording on the floor of the car park. There are also 2 different signs in the car park from 2 different companies with 2 different rules on it. And also different charge notice amounts! Car was photographed nearer pcm's time plate.

My argument:

2 different signs in 1 car park from 2 companies is confusing as drivers do not know which set of rules apply and which company is responsibly for enforcement.

Car was stopped before ENTRY sign it was not in the car park therefore.

What do you think? Should I appeal on these grounds?

    Company that sent me a notice is:
    Parking Control Management (UK) Ltd
    The Courtyard 1A Cranbourne Rd
    Slough, Berks, SL1 2XF

    It was a Postal Notification of Parking Charge. There was no ticket on the windscreen.

    On their website they are bragging about winning the case against motorist in Leon House Croydon.

    PCM (UK) is an IPC operator, so use the IPC initial appeal template from the NEWBIES sticky. It's designed to show that you've engaged with the PPC's own appeals process. But you shouldn't expect anything from it other than a rejection.

    Nothing you can write to them will result in a cancellation; the template just ensures you don't blow off some of your toes, such as saying who the driver of the vehicle was (you seriously need to edit your opening post!).

    For an IPC operator there is no second stage appeal worth pursuing as the IPC's IAS service is so biased towards the PPC, you have no prospect of success, so we advise you don't expend any energy on that. In addition, to have received 2 rejections of your appeal (including one by an 'independent' appeals service) will give the PPC more ammo to consider launching legal proceedings.

    After your initial appeal rejection and your ignoring of anything further from PCM (UK), you will receive debt collector letters - powerless (covered in the newbies sticky, post #4) - and can be safely ignored. You may, in due course receive a court claim from PCM (UK) which should not be ignored. Come back if you receive one - we can help. They have 6 years to pursue through the small claims court.

    I'm afraid you're in this for the long run, unless you can get a landowner cancellation, so you'll need to do a bit of digging to find out who that is. If you can't find the information for free, you can pay The Land Registry to give you the details (£3 was the going rate a few months ago).

    A link to a picture showing the immediate area around where you were parked, such as the part leading up to the 'entry' wording, and showing any car park signs, could be useful.
