Water Babies

hi there,

Can anyone provide me with any help with this please?

Basically I have completed 2 stages of water babies, which costs £150/stage (10 weeks/stage). They take the payment about 3 or 4 weeks before the end of each stage for the next stage. however I now want to cancel it and the payment has gone out. I have rang up to cancel and to get a refund, and they have said they will charge £50 for cancellation so will only refund £100. The third stage hasn't started and I have not intention of starting it. Can this be allowed? Or am I entitled to my full refund?

Thanks in advance.

What terms and conditions were you given on signing up? What do those say about minimum duration/rollover etc?

Is this what you are referring to or did you sign up to something similar elsewhere?

If it was the one above, it states:
If you do not wish to be re-booked for any new term it is vital that you inform the office by the stated re-booking deadline. You can do this by either email or post. If you have granted us a continuous payment authority and you have not contacted us by the specified deadline your place will be re-booked and the refunds policy referred to below will apply.

We did several years of Waterbabies and that looks like what we agreed to. Reminder emails were also sent out prior to the payment being taken and a final reminder about the deadline to cancel. I believe it is run as a franchise (from memory) but I think most of the admin follows the same format.

As it is a fairly structured teaching programme they will not get someone to replace a customer who cancels unless it is another existing customer who is switching class day/time.

It cost us a fortune (170 lessons so you can do the maths!) but it was worth the expense and time it took as our daughter loves swimming above every other activity.

Yeah those are the conditions I signed up with, but I think it's a bit rich that they take the payment so early! My son is having issues with swimming at the moment. For the last term he has managed about 10-15mins per session then just hates it. The instructor said she's unwilling to let us go to the next chapter as he hasn't really progressed. Surely that's enough for me to get a refund?

Would depend, are they offering to redo the current stage instead of advancing him?
