Hi we were hit by another car yesterday when driving yesterday, the 3rd party came over to our lane when he tried to retrieve something from the footwell,
Our car was removed at the scene by the police and early indications are a total loss on the vehicle.
We don't have free legal cover with the car insurance but do have accident cover on home insurance.
I'm confused what Is pursued through insurance and what through legal action?
My partner and I have shoulder and back injuries and currently have no car!
Many thanks for any help or advice

Also the 3rd party admitted full liability to ourselves and the attending police officers on record0

Also unsure what to do about my daughters car seats in the car as feel really the insurance should cover them?0

your house insurance will usually have a disclaimer and not cover car related issues
You may have to pursue one of those no win no fee solicitors if you want to pursue a claim, but beware they can take about 25% of your claim. Also it is not guaranteed and may affect your premiums if a claim is still open.
Insurers are clamping down on whiplash injuries, ensure you have an audit trail of this such as GP and this genuinely causes you to be off work for example. They do and will covertly film you if they suspect something is a miss.
In terms of whether the insurers will cover car seats, it should be part of the settlement and read the T+Cs of specifically what is covered.
Motor legal can be free for some insurers and doesn't cost much if you pay for it."It is prudent when shopping for something important, not to limit yourself to Pound land/Estate Agents"

Hi thanks for the reply and help,
Our legal service from our home insurance said they will only deal with personal injury,
I feel we need someone to work on the whole of the claim so I'm guessing our only option for that is the no win no fee solicitors?0 -
Are you a member of a union or the RAC etc etc0

Hi thanks again for the reply yes I'm in Unite union and the RAC0

If the other party have admitted blame, then deal direcitly with the other parties insurance company.
Inform your own insurance that there has been an incident, that is all you need to do.
Deal with everything else directly with the other company.
You only need legal help for any personal injury you have suffered.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
Thanks for you reply, ah have we made a mistake accepting the hire car (not courtesy) car from our insurance? The terms of it are that they will cover costs from other party if liability accepted0
