If the car park was on private land then it is not a fine.

If ANPR cameras were used then there is no requirement to issue a windscreen ticket.

Please give us some more information.

What is the name of the parking company?
What is the date of the alleged event?
What is the date when you received the charge through the post.

Meanwhile please read the sticky thread for NEWBIES that you appear to have missed. It is just below where you clicked the New Thread button and invites you to read it before doing anything else.

If this ever got to court, it would be your mother's word against a private parking company, and the judge would have to decide, who, on the balance of probabilities, was telling the truth

Given what I have read about the scams some of these companies get up, If I was that judge, unless she has previous, I would be inclined to side with your mother.

You do not need to prove that you paid, they need to prove that you didn't.

It's a common occurrence. As advised before follow the instructions in the Newbies thread.

I had a quick look at the advice but can't really see where there is an example of someone paying in full and then getting fined.

Loads like that here. But you don't need specifics. Just follow the NEWBIES thread.

I did make sure I read that thread first but it is incredibly technical and confusing

Seriously? Loads of newbies manage this all the time, every day.

There is ONE appeal for BPA member firms, already written to copy & paste. Very easy.
And unfortunately I've now found out my mother has already sent off the letter saying she paid the full price ticket cost and will not be paying any money to them before I even could get on the net for any advice so I guess basically we'll have to just wait and see what happens and ignore from now on any more letters?
Yep - and it's only Euro Car Parks, they were the first PPC I ever ignored myself!

Well it's difficult for me since I have only seen the letter briefly so I'm not sure exactly what the letter said. And I do see quite a few posts being redirected to the newbie thread so clearly I'm not the only one...

I know, you don't like people asking questions because everything is covered in the newbie thread, it's a forum but all the possible info in the world is covered in the newbie thread so go read that and don't ask any questions! :D I felt my situation was different, the vast majority of people have gone over the time, not seen signs whatever, thus the blue template applies to them. Knowing we paid for the full time and did nothing wrong makes it kinda different since you would just reply back saying "sorry you got this wrong, I know for a fact the parking was paid fully" thus admitting who was driving. To not admit the driver or if the parking was paid ignores the facts of the case-the fact that the "contract" wasn't broken. Who knows, if they are not trying it on they may come back and realise they've made a mistake and admit that we DID pay.

I know I know, you would still say just use the template and don't admit the driver. Ok well, no point using the template now it's too late anyway the reply has already been sent off. Thanks for replies.

Not sure whether you were having a stomp with your deletions of your posts, but it would have helped you much more if you'd have answered Fruitcake's questions (below) rather than having a rant about the NEWBIES sticky.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
