Over 10 years. I started 21st Aug 2006. My letter from the company arrived on Saturday 6th, and from the administrators on wed 10th if that makes any difference.0 -
It sounds like if you go back, you'll be working for a different company? Assuming the first one is still heading for insolvency?
Or is the offer to go back to the company in insolvency?
I would assume it would be the same as last time... (without the redundancy) where employees and clients basically carried on the same with a different company name before the t/a name. Many people didn't even notice. In theory I would be back with old co and transferred to new co. We aren't told things for me to be 100%0 -
If they couldn't afford to pay your statutory redundancy pay, then how come they had your replacement already recruited-and presumably receiving a salary. How could they afford to pay them?
If the company is still trading and solvent then they are obliged to pay you your redundancy pay. 'Likely to wind up in the near future' just doesn't get them off the hook. Though, since your job clearly wasn't redundant, you appear to have a valid claim for unfair dismissal.
Take some professional advice on this-a decent employment lawyer would have a field day with it.No free lunch, and no free laptop0
