Default on account that Creditors deny putting on

Wondered if anyone can help me with this. I've been in a DMP since early 2013, most of my creditors defaulted me within 12 months. I'm still in my DMP but am hoping to offering settlements this year.
Last year my debt with Barclaycard was sold to Link Financial with a default date of September 2016, as I've been paying reduced payments since early 2013 this doesn't seem fair to be as they should have registered the default when I was 6 months in arrears which would probably have been around October 2013. For reference I also had 2 accounts with Barclays and they defaulted me within 3 months so surely it should be the same across the board within the Company, I know its a different arm but they all had the same information.
The debt to Link was also sold in September 2016. The problem that I've got is that I want to dispute the date of the default , however I have rang both Barclaycard and Link Financial and both are adamant that they haven't registered a default on my account.
I don't know where to go from here, Link has supposedly wrote to Barclaycard but Barclaycard have denied receiving a letter from them. I've queried it with Equifax and as of yet Link haven't responded to that.
The default itself is showing under Link Financial. Barclaycard say they weren't in control of that account at that time however the default date is showing as the 14th September 2016 and per the credit file report it shows that Barclaycard closed the account on the 22nd September 2016.
I've tried to ring Barclaycard, however last time I rang ad I specifically asked to speak to complaints I ended up speaking to a very arrogant service adviser who throughout the call just kept informing me that he had worked for Barclaycard for 7 years and his only advice was to get Link Financial to ring them.
I've told Link this information and still they haven't rang. I've already been in a queue for an hour and a half this morning with Link and still no one has answered the phone. When I last rang Barclaycard they just hung up.
I feel like I'm going round in circles, I just feel its very unfair that I got into financial difficulty in 2013, and then default gets registered in 2016 that will now remain on my file until 2022- over 9 years after my problems. How is any of that meant to help me in the future.
But how can I begin to rectify the problem when both parties are denying putting the default there in the first place.

    Hi,

I know how frustrating this can be, but you must stop ringing these people, you only ever get the call handler on the phone, you need to communicate with the compliance dept, and the only surefire way to do that is a good old fashioned letter of complaint.

Your issue is actually with Barclaycard, they should have defaulted you earlier in the debt collection process (they are notorious for doing this, the forum is full of similar complaints about them).

What you need to do, is write to Barclaycard, address your letter "COMPLAINT" and underneath "COMPLIANCE DEPT", send to there usual customer service address.

You need to state categorically that this issue occurred whilst BC still owned the account, so it is there issue to deal with, now both dispute a default was even registered, so bypass that by telling them to default your account in line with FSA guidelines, and back date it to the date you say should be correct.

Hopefully you will get a result from that, but if not, you can take your complaint to the information commissionaire (ICO) to deal with, but you must let BC try to put things right first.

  • I'll get onto writing to Barclaycard now. I've actually been looking through my online correspondence with my DMP and can see that in Feb 2015 I received a letter from Barclaycard that reads "DEFAULT NOTICE SERVED UNDER ......"
Should I enclose this letter with my compliant surely if I received this off them and didn't do anything to bring the account up to date like it states I should do in the letter to avoid a default then this is the date that the default should be registered from.
