HSBC mortgage PPI claim refused, what next?

Using Resolver last week, I submitted a refund request to HSBC, formerly midland Bank. They replied this week saying that they checked on their 'live' systems and I am not owed any PPI. Should I have evidence, I should send this to them.


So, I have my bank statements, the very first payment being Jan 1998 and the last payment in 2005.


As I have this evidence, should I:
(a) send HSBC the evidence to allow them to process the refund
(b) write to the Ombudsman


I read somewhere on the Martin Lewis site, that I should expect a refusal and to the Ombudsman next.
On the Resolver site, it says that I need to wait 2 months before I go to the Ombudsman (I seriously do not want to wait)


I'm just confused which direction I should go


Who here has experienced what? Tell me, so I can decide what my next step is

    What were your complaint reasons?

    How is the insurance that appears on your statements described, is it definitely PPI?

    Did the bank say their records show you had no PPI or that that you did have PPI but they do not agree it was miss-sold?

    Given that you are looking back over twelve years, I doubt there will be any evidence on the live system. Send them what you have, as they have requested (why did you not send them in the first place?). The ombudsman would expect you to do so.

    MPPI complaint success rates are low, it is a good idea to have cover. What is your reason for complaint?

    Was it MPPI? (could it have been life assurance)
    Did HSBC sell you the MPPI? (a broker arranged one for example)

    You dont get a refusal as your complaint has stalled. Although, technically, the letter telling you they find no evidence is a rejection. However, there is little point going to the FOS as HSBC will tell them they have no record and unless you have supplied evidence, they will say they cant look into something that there is no evidence of having.

    So, its best to give HSBC what evidence you have. And make sure its PPI and not something else.

    Thanks for responding.

    The bank said that their live and archived records only go back 6 years and therefore cannot see any PPI sold to me.

    I have photocopied the bank statements and other paperwork to support my claim and will post it off to HSBC today

    DD REPAY PRO-HSBC

    I am assuming this is PPI?

    I'll take the chance and send my evidence off to HSBC today

    Why are you assuming this? It sounds to me like a monthly loan repayment.

    Regardless, you need to understand that you are not "owed" any money and you need to show any PPI was mis-sold to you. You can't simply "request" a refund.

    Why don't you call HSBC and ask them what this payment pertains to? Then, if it is what you hope, you can then construct a valid mis-selling complaint showing that the PPI (if you had it) was not needed or wanted or was somehow unsuitable.


    It's really not enough just providing "proof" of PPI and expecting a refund..
