    Looking more closely at the Thomas Higgins website, it looks as if this company specialise in the collection of commercial business debt not personal or consumer debt.
    I also get the impression that they are happy to accept anybody as a client, involve themselves and send out their letters without asking for any proof of the validity of the claim. What happens when the recipient of their letters starts disputing the alleged debt, asking for proof, asking for this that or the other. What do they do? If their client has only paid £3, very little I would imagine. Could sending their letters threatening baliffs etc to a company with a good legal department not land them in big big trouble especially if the claim was vindictive, malicious or false?

    Read the letter again very carefully, somewhere it will say "this is what we could do".

    They cant enter judgement against you, only a court can do that, any chance you can post up a picture of the letter, minus your personal details of course ?

    On Friday, a letter arrived from Thomas Higgins demanding £165. Money supposedly paid in error to my wife's business bank account by her ex-employer.

    She has been on holiday faraway in Africa when this transaction was made in error. She has no knowledge of the transfer as she could not monitor her bank account from there due to unsecured public computer in the remote village she's currently located. And I equally don't have the time to monitor her bank account to see who's paying in money by mistake. Lol.

    It only came to our knowledge when their letter came on Friday. I tried to call the employer on her behave to let them know she has no knowledge of the transfer plus, it's their error in the first place. Also told them she's due to be back in the UK on June 8 when she shall be able to send back the money to them.

    We haven't heard back from the employer. She is currently having a panic attack and distressed emotionally when she should be enjoying her holiday. Any advice will be greatly appreciated here.

    When she comes back, she can confirm the amount and return any overpayment which was made.

    No point in worrying about it until then.

    If the letter was addressed to your wife she has good reason not to see it or open it. If she is away form m hme for whatever reason holiday. in an iron lung in hospital . in a coma tec, the letter would still be ion the mat unread.


    Is there some kind of threat in the letter ? what is the threat ? Save the letter for an industrial trubunal lol.

    Iit passes a reasonableness test thAT a communication is sent to stating she wIll deal with this on her return. The amount is trivial.


    Come to think of it does she have to return it ?

    It stated in the letter that if she doesn't pay within 7 days (which expired last Friday), that she will incur interest and legal fee. Very funny innit? What's the penalty for abuse of law?

    Depends on the law being abused.
