Charge Certificate

I recently appealed a yellow box junction ticket and lost at Tribunal. The full amount of the fine was payable and the adjudicators letter provided instructions for payment to be made to the Council's address. I sent a cheque and obtained proof of posting. The Council now allege they didn't receive the cheque even though I sent them proof of posting and have issued a Charge Certificate asking for a further £65.

I have now been told that the next stage is that the Council will file an Order for Recovery. I will then be given an opportunity to swear a statutory declaration citing one of 3 grounds of appeal. None of those grounds apply to my situation (that I made payment by cheque in the post and obtained proof of posting).

I'm terrified I will now have to pay another £65 that I can little afford due to the Council's incompetence. I feel that i've got nowhere to turn and the law isn't on my side even though I tried to pay in accordance with the instructions given and have offered to pay the £130 again. Help :-( I feel so stressed and anxious.

And did this show as cashed on your bank statement? If not you have not paid the fine. For more advice post on peppipoo, this is for private land tickets.
