Pothole claim beyond 90 days.

Morning all,

I submitted a pothole claim to Liverpool council back in January. It was acknowledged and I was told it would be investigated and I would hear back 'within the relevant period prescribed by the Pre Action Protocol'. In further correspondence, the claims coordinator informs me this is 90 days.

Today we are on 81 working days since acknowledgment. My question is, what happens after 90 days? What further action can I take?

After the 90 days you're free to take them to court.

BTW I'd be surprised if it's 90 WORKING days. If it's been 81 working days, then the 90 calendar days are already up..

Outside the protocol period, you can sue their asses. Go for it if you know what you're doing and think you have a valid claim.

This is the stage at which most people who are trying it on seem to lose interest in making a claim.
