Collection only - wants to return

Hi I'm new here so please be gentle lol.

Basically several weeks ago a sold a bundle of items and stated collection only. The items were collected no problem (paid via PayPal) even though I stated cash on collection.

Anyway 2 weeks later the buyer messaged saying some items were missing. I've offered two partial refunds and to send replacements even though I knew the "missing" items were there.

They have asked to return which I said fine, even though I will now be at a loss because one of the items is now going to be no good to anyone.

The day they wanted to return I was working and they said they couldn't do any other day.

They've opened a case with eBay and PayPal have of course suspended my account.

They are now asking to return by post. It's far too much stuff to return by post hence why I stated collection only in the first place.

Question is where do I stand now? I'm out of pocket as it is with eBay and seller fees and if he does return in person I'm going to be another £60 down. Postage would be extortionate!

Please help! I've tried to be as reasonable as possible, giving him the benefit of the doubt when I think it's just buyers remorse

Why have PayPal suspended your account?

  • Well not suspended sorry. Froze £160 - I've already downloaded the money so now I'm in the red if you see what I mean
  • You are very lucky your buyer didn't open an item not received case as he'd have won.

However, in respect of your current issue, can you collect the items in person? he would then be unable to prove that he'd returned them as he'd have no tracking and your funds would be released. Devious, but it is a solution.
  • Ebay always favours the buyer, which is horrible, I've been where you are! I'd go with Lioness' very sensible suggestion, offer a range of dates and times you can pick up.

This is why I NEVER allow personal collection with paypal. It's a right can of worms!

The reason that he now wants to send it back to you is that PayPal require him to send it and upload the tracking, which he realises he can't do if you collect it. However I would not agree with the posters above stating you should collect and keep the money as you would probably end up in court. Can't you go round to look at what he's got and try to resolve the situation amicably?

I am not sure if this helps at all as it did me in a similar case.
About a year ago someone bought a PC RAM stick off me. It was about 4 miles from me. So I dropped it through the letterbox. A few days later I get the not received item claim.
However I won the case. How? Well I proved I was actually at the person house delivering. I took a photo of the item, with a date of a newspaper, outside the house. All in one photo and also uploaded google earth street photos so EBAY could compare instantly.

Basically, if you go to collect you must prove you were there and the item was on their premises at some point to cover yourself. Remember if it all went to court it's all admissible evidence!

I think you may be misreading the OP, item is not being claimed as lost but a return is expected.

If you won a case by claiming item was dropped off then you are very unique as I don't recall anyone else ever managing to get round the seller requirements for online tracking on an INR.

Doesn't prove that you posted it in the letter box though.

I had a photo of it next to the letterbox as well.

I won the case, but yes I do wonder how!
