Fruadulant Application by Ex

I recently sent off to Capital One to try and claim back PPI costs. Yesterday, I recieved a copy of my application, clearly stating that I had requested to Purchase the PPI. Fair enough ... nothing ventured, nothing gained.

However, the application form wasn't even filled in by me. Quite clearly my ex filled it in and forged my signature.

I am wondering where I stand legally ... I am happy with the card, but should it become a problem in the future, could I use this situation to my advantage>

    You've used the card etc and have accepted ownership and that,therefore any claim by you that it is a fraudulent application will frankly be laughed at

  • Yes but to get even you would be shooting yourself in the foot so to speak.
    By using the card you are a party to the fraud.

    Thanks ejones, that is what I am concerned about. Yes, it was many years ago, and I don't remember applying for it. I have used it and managed it as if it was my own. But what would happen in the future should it come back to haunt me, as I am party to the fraud, as I have just learned about it?

  • If you have accepted the amount outstanding as your own then for all intent and purpose it is your card and debt and you can carry on using it as you apparently have for years.
    Your ex is surely not going to say that he/she fraudently applied for the card are they?

    Sorry, but I don't understand this. Are you saying your ex applied for a card to be issued in your name, without your knowledge? Surely if that was the case you would have though it a little odd when a card turned up out of the blue?!!

    Alternately, was the application in their name, with you named as second card-holder, and they signed to purport you were aware of the application? Again, though, a card would have turned up unexpectedly and I can't imagine you would have thought that normal!

    As the others have said, you have operated the account as your own, so have accepted the "fraud" so from the card company's point of view the fact you didn't sign originally is pretty irrelevant. It would only be an issue if the person who fraudulently signed was the user of the card and then defaulted, which is clearly not the case. (That's from personal experience, BTW).
