Stamp Duty Land Tax

Hello all,

I can't seem to get a straight answer to this question and wondered if anyone can help please?

I understand that Stamp Duty Land Tax is not payable if property is being transferred in a divorce.

If my husband is buying me out of our house, as part of a divorce, but is jointly buying me out with a friend, is Stamp Duty Land Tax payable?

If anyone can clear this up I would be very grateful...

    depends what you mean by friend is jointly buying you out? Will friend end up as a co owner with ex husband?

    is friend paying cash to your ex husband so your ex husband has enough cash himself to buy you out

    obviously the "purchase" by ex husband is exempt under the divorce rules, but they will not cover any "chargeable consideration" (ie cash) given by friend if friend gets an ownership stake in return.

    My husband and his friend are going to get a joint mortgage for 50% of the value of the house so that my husband can buy me out. They are going to live in the property together and do it up, and then sell it later on,
